A careful Answer, informed by the investigative file, frames your whole defence.<\/p>\r\n\r\n    <h2>The settlement route: compliance conference and Consent Order<\/h2>\r\n    <p>Most Michigan cases are resolved at the <strong>compliance conference<\/strong>, where you (through counsel) negotiate with LARA and the Attorney General&rsquo;s office. A negotiated resolution becomes a proposed <strong>Consent Order<\/strong> &mdash; which only becomes binding once the <strong>Disciplinary Subcommittee (DSC) approves it<\/strong> (the DSC can accept, or reject with modifications, leaving you to accept or decline the counter-offer). Because a Consent Order is public and part of your permanent record, its terms are worth negotiating carefully.<\/p>\r\n\r\n    <h2>The contested route: a hearing before an ALJ<\/h2>\r\n    <p>If there&rsquo;s no settlement, the case goes to a formal hearing before an <strong>administrative law judge at the Michigan Office of Administrative Hearings and Rules (MOAHR)<\/strong>, where the Attorney General prosecutes and you present your defence. The ALJ issues a <strong>Proposal for Decision (PFD)<\/strong> &mdash; but, importantly, the <strong>Disciplinary Subcommittee decides whether to accept, reject or modify it<\/strong> and imposes any sanction. The DSC, not the judge, has the last word.<\/p>\r\n\r\n    <h2>The range of penalties<\/h2>\r\n    <p>If a violation is found, sanctions under <strong>MCL 333.16226<\/strong> can include a <strong>reprimand<\/strong>, a <strong>fine<\/strong>, <strong>restitution<\/strong>, <strong>probation<\/strong>, a <strong>limitation<\/strong> on your licence, <strong>suspension<\/strong>, <strong>revocation<\/strong>, and even <strong>permanent revocation<\/strong>. Conditions such as additional education, monitoring or HPRP participation are common. The <strong>Final Order becomes part of your permanent public record<\/strong> and is reported to the National Practitioner Data Bank.<\/p>\r\n\r\n    <h2>Summary suspension &mdash; and appeals<\/h2>\r\n    <p>In serious cases you may be served with an <strong>Order of Summary Suspension<\/strong> alongside the complaint, stopping you practising immediately, before any hearing. That&rsquo;s not the end: you can file a <strong>Petition for Dissolution<\/strong> to get an expedited hearing to lift it.
