The Board&rsquo;s <strong>Compliance and Enforcement Department<\/strong> &mdash; whose agents have law-enforcement authority for drug-law purposes &mdash; then gathers the evidence: dispensing and pharmacy records, OARRS query data, and statements from witnesses. In most cases, investigators will also want to speak with you.<\/p>\r\n\r\n    <div class=\"note\">\r\n      <span class=\"note-h\">Be careful with the investigator<\/span>\r\n      <p>An investigation interview is not a casual conversation, and what you say can be used to support formal charges. You are entitled to counsel and, in most situations, to decline an immediate statement until you are advised. A measured, documented written response, prepared with an Ohio license-defense attorney, is usually the better route than an off-the-cuff account.<\/p>\r\n    <\/div>\r\n\r\n    <h2>The Notice of Opportunity for Hearing<\/h2>\r\n    <p>When the Board decides the evidence supports action, it issues a <strong>Notice of Opportunity for Hearing<\/strong> under ORC 119.07. This is the pivotal document. It sets out the specific allegations, identifies the provisions of ORC 4729.16 said to be violated, and lists the sanctions the Board may impose. It also tells you something critical: you are entitled to a hearing <em>only if you request one within 30 days<\/em> of the notice being mailed.<\/p>\r\n\r\n    <h2>The 30-day deadline<\/h2>\r\n    <p>That 30-day window is the most important deadline in the whole process. If you request a hearing in time, the case proceeds to an adjudication. If you do <strong>not<\/strong>, the Board can proceed without you: under ORC 4729.16(F) it may review the allegations and adopt a <strong>final order without holding a hearing<\/strong>, imposing any of the sanctions in the notice. In other words, silence does not pause the case &mdash; it can decide it.<\/p>\r\n\r\n    <h2>The Chapter 119 hearing<\/h2>\r\n    <p>If you request a hearing, the matter becomes a formal <strong>adjudication under ORC Chapter 119<\/strong>. A hearing examiner presides; the Board presents its evidence, you present yours, witnesses testify and are cross-examined, and a record is made. The examiner prepares a report and recommendation, and the <strong>Board<\/strong> then issues the final adjudication order. If you disagree with that order, Ohio law gives you a right of appeal to the Court of Common Pleas under ORC 119.12 &mdash; but only if you file within a short window, so timing again matters.<\/p>\r\n\r\n    <h2>Summary suspension and impairment<\/h2>\r\n    <p>Two Board powers can change the timeline. Where a pharmacist poses a danger, the Board can issue a <strong>summary suspension<\/strong> that takes effect immediately and lasts until a final order &mdash; in some circumstances by a telephone-conference vote. And where the Board has reasonable cause to believe a pharmacist is physically or mentally <strong>impaired<\/strong>, it can order an examination; a <strong>failure to submit<\/strong> to that examination counts as an admission of the allegations and results in suspension.<\/p>\r\n\r\n    <h2>What the outcome can be<\/h2>\r\n    <p>An investigation can end in several ways: closure with no action; a negotiated <strong>consent agreement<\/strong>; a Board order after a hearing; or, where no hearing was requested, a final order without one.
