The governing law is the <strong>Georgia Nurse Practice Act (O.C.G.A. Title 43, Chapter 26)<\/strong>, with rules in <strong>Chapter 410 of the Georgia Administrative Code<\/strong>, and the Board works with the <strong>Attorney General&rsquo;s Office<\/strong> on legal action. It regulates RNs, LPNs and APRNs (including nurse-midwives and nurse practitioners).<\/p>\r\n\r\n    <h2>Who can report you &mdash; and the duty to report<\/h2>\r\n    <p>Anyone with knowledge of a possible Nurse Practice Act violation may report a nurse. But Georgia goes further with <strong>mandatory reporting<\/strong> (O.C.G.A. 43-26-53): <strong>nurses must report other nurses<\/strong> they have reasonable cause to believe violated the Act, and <strong>employers must report<\/strong> a nurse who is terminated &mdash; or who <strong>resigns to avoid termination<\/strong> &mdash; for reasons under the Act. That last point closed a real gap, and it means a resignation doesn&rsquo;t make a matter disappear.<\/p>\r\n\r\n    <h2>What the Board can &mdash; and can&rsquo;t &mdash; act on<\/h2>\r\n    <p>The Board acts on violations of the Nurse Practice Act &mdash; negligence, substance misuse, unprofessional conduct, practising beyond your licence, criminal convictions and the like. It generally has <strong>no jurisdiction over business practices, billing or fee disputes<\/strong>; those are civil matters. When a complaint arrives, the Board first checks jurisdiction, then decides whether to investigate.<\/p>\r\n\r\n    <h2>How confidential is it?<\/h2>\r\n    <p>Georgia law makes <strong>investigative files confidential<\/strong> for any purpose other than a Board hearing (they can be shared with another enforcement agency). You may <strong>not be told who complained<\/strong>, and the Board can&rsquo;t give you status updates while an investigation is open. But note the other side: if a case is resolved by a <strong>public consent order<\/strong> or a hearing, that becomes public and is reported to <strong>Nursys and the National Practitioner Data Bank<\/strong>.<\/p>\r\n\r\n    <h2>You may &mdash; or may not &mdash; be contacted<\/h2>\r\n    <p>A complaint is first reviewed by an investigator, who decides whether it warrants action. <strong>You may or may not be contacted<\/strong>: minor or non-jurisdictional matters can be closed without ever involving you, while more serious allegations lead to a formal investigation in which you&rsquo;ll be asked to respond.<\/p>\r\n    <aside class=\"note wb\"><p><span class=\"note-h\">A resignation is not an escape<\/span>Because Georgia employers must report a nurse who resigns to avoid termination, quitting rarely ends a matter &mdash; it may start one.
