The governing law is the <strong>Ohio Nurse Practice Act (Ohio Revised Code Chapter 4723)<\/strong>, with the grounds for discipline set out in <strong>ORC 4723.28<\/strong> and the rules in the Ohio Administrative Code. The Board regulates RNs, LPNs and APRNs (including certified nurse-midwives) as well as dialysis technicians.<\/p>\r\n\r\n    <h2>Who can file &mdash; and the reporting duty<\/h2>\r\n    <p><strong>Anyone can file a complaint<\/strong> with the Board. Notably, <strong>an employer who believes a nurse engaged in conduct that&rsquo;s grounds for discipline must report it<\/strong> (ORC 4723.34), and <strong>nurses themselves must report<\/strong> suspected violations &mdash; failing to report can be a violation in itself.<\/p>\r\n\r\n    <h2>You may never see the complaint<\/h2>\r\n    <p>This is a distinctive Ohio feature: <strong>complaints can be anonymous<\/strong>, the <strong>complainant is generally immune from liability<\/strong> (absent bad faith), and <strong>you may never be given a copy of the complaint or the complainant&rsquo;s name<\/strong>. So you might learn of a matter &mdash; for example, an undisclosed DUI &mdash; only when an investigator contacts you.<\/p>\r\n\r\n    <h2>It&rsquo;s confidential<\/h2>\r\n    <p>Information the Board receives through a complaint or investigation is <strong>confidential and not subject to discovery in a civil lawsuit<\/strong> (ORC 4723.28), though it can be shared with law enforcement for an investigation.
