You must file a <strong>written Answer within 30 days<\/strong> &mdash; with the Prothonotary in Harrisburg, and a copy to the prosecutor. <strong>Miss it and the Board can act without a hearing.<\/strong> Your Answer should meet each allegation on the facts and the law; this is not a formality, and it sets the tone for everything after.<\/p>\r\n\r\n    <h2>Settle or be heard: Consent Agreement vs hearing<\/h2>\r\n    <p>The prosecutor can negotiate a <strong>Consent Agreement and Order<\/strong> at any stage &mdash; agreed facts and penalties, subject to Board approval &mdash; which is often the route to a lighter, more predictable outcome. If there is no agreement, the case goes to a <strong>hearing before a Hearing Examiner<\/strong> (appointed by the Governor&rsquo;s Office of General Counsel), where both sides present evidence and cross-examine witnesses. A person harmed may submit an <strong>impact statement<\/strong> on penalty.<\/p>\r\n\r\n    <h2>From Proposed Adjudication to Final Order<\/h2>\r\n    <p>After the hearing, the Hearing Examiner issues a <strong>Proposed Adjudication and Order<\/strong> with findings of fact and conclusions of law. Both sides may file <strong>exceptions<\/strong>, and the <strong>State Board of Nursing then issues the Final Adjudication and Order<\/strong>. The Board can adopt, modify or reject the examiner&rsquo;s proposal.<\/p>\r\n\r\n    <h2>The range of penalties<\/h2>\r\n    <p>Under the Nursing Law, sanctions include a <strong>public or private reprimand<\/strong>, a <strong>civil penalty of up to $10,000 per violation<\/strong>, <strong>probation<\/strong> with conditions (supervision, treatment, reporting), a <strong>stayed suspension<\/strong>, <strong>suspension<\/strong>, <strong>revocation<\/strong>, or a <strong>voluntary surrender<\/strong> &mdash; plus the <strong>costs<\/strong> of investigation and prosecution, and often <strong>remedial education<\/strong>. Certain drug-related convictions trigger an <strong>automatic suspension<\/strong> by statute.<\/p>\r\n\r\n    <h2>Appeals &mdash; and the reach beyond Pennsylvania<\/h2>\r\n    <p>You can appeal the Board&rsquo;s Final Adjudication to the <strong>Commonwealth Court of Pennsylvania<\/strong>.
