The Board sets standards and imposes discipline, but the <strong>investigating and prosecuting are done by BPOA<\/strong>: the <strong>Professional Compliance Office<\/strong> screens complaints, the <strong>Bureau of Enforcement and Investigation (BEI)<\/strong> investigates, and a <strong>prosecuting attorney<\/strong> brings any charges. The governing law is the <strong>Professional Nursing Law<\/strong> (for RNs) and the <strong>Practical Nurse Law<\/strong> (for LPNs), with rules in <strong>49 Pa. Code Chapter 21<\/strong>. The Board regulates RNs, LPNs and CRNPs; note that <strong>certified nurse-midwives<\/strong> are licensed through the State Board of Medicine.<\/p>\r\n\r\n    <h2>How a complaint starts<\/h2>\r\n    <p>Anyone can complain &mdash; patients, employers, colleagues, other state boards, or law enforcement &mdash; by filing a <strong>Statement of Complaint<\/strong> with the Department of State. The <strong>Professional Compliance Office<\/strong> screens it: does it allege a violation of the practice act, is it within the Board&rsquo;s jurisdiction, and is there enough to merit investigation? Many complaints close at this stage.<\/p>\r\n\r\n    <h2>The investigation<\/h2>\r\n    <p>If a complaint warrants it, a <strong>BEI investigator<\/strong> gathers evidence &mdash; interviewing witnesses, obtaining records, and sometimes appearing at your home or workplace &mdash; and passes it to the <strong>Prosecution Division<\/strong>. An important point: <strong>you are not obliged to give a statement without your attorney present<\/strong>, and anything you say can be used to support the State&rsquo;s case. Cooperate with document requests on advice, but don&rsquo;t give an unprepared interview.<\/p>\r\n    <aside class=\"note wb\"><p><span class=\"note-h\">Before you talk<\/span>Investigators may appear at your home or workplace and suggest a quick chat. You are not required to give an interview without counsel &mdash; and it is wise not to. Say you&rsquo;ll respond through your attorney.<\/p><\/aside>\r\n\r\n    <h2>The Order to Show Cause &mdash; and your 30 days<\/h2>\r\n    <p>If the prosecutor decides to proceed, they file an <strong>Order to Show Cause (OSC)<\/strong> &mdash; the formal charging document &mdash; before the Board. You then have <strong>30 days to file a written Answer<\/strong>. This deadline is critical: <strong>if you don&rsquo;t answer, the Board can discipline you without a hearing<\/strong>. The OSC will also warn that you face possible <strong>civil penalties of up to $10,000 per violation<\/strong> and the <strong>costs of investigation<\/strong>.<\/p>\r\n\r\n    <h2>What the Board can act on<\/h2>\r\n    <p>The Board acts on violations of the Nursing Law &mdash; substandard or unsafe practice, unprofessional conduct, fraud, impairment, and criminal convictions related to fitness to practise (a <strong>conviction under the Drug Act can trigger an automatic suspension<\/strong>). It generally won&rsquo;t pursue pure fee disputes or personality conflicts.<\/p>\r\n\r\n    <h2>Is it public &mdash; and does it reach beyond Pennsylvania?<\/h2>\r\n    <p>Investigation materials are confidential unless used in a formal proceeding, and a complaint that closes without action is not public. But a <strong>final disciplinary action or a Consent Agreement is public record<\/strong> (the Board can expunge some matters after five years).
