first contact is a letter requesting your records with little explanation of what comes next. The process, though, follows a defined path \u2014 from investigation, to a possible informal conference, to a formal complaint and hearing. Knowing each step, and where your rights sit within it, lets you engage from understanding rather than dread.<\/p>\r\n<div class=\"callout\"><strong>Before you do anything:<\/strong> Being investigated is a fact-finding stage, not a verdict. How you handle it \u2014 organized, measured and well-advised \u2014 can materially affect where it ends.<\/div>\r\n<h2>The investigation stage<\/h2>\r\n<p>Most matters begin with the investigation stage. IDFPR typically writes to ask you to produce the patient's records and other relevant information \u2014 proof of continuing education, answers to specific questions, or a written narrative of the care you provided. IDFPR investigators have real authority here: they can subpoena documents and compel testimony.<\/p>\r\n<p>Take these requests seriously, but not hastily. An IDFPR prosecutor or investigator may contact you for statements or records, and it is wise to speak with counsel before agreeing to an interview or producing documents. What you provide and say at this stage frames everything that follows.<\/p>\r\n<h2>The coordinator and the Complaint Committee<\/h2>\r\n<p>When the investigator considers the inquiry complete, the reports are reviewed internally. In medical cases the file goes first to a coordinator \u2014 a licensed physician who acts as an in-house expert \u2014 and then to the Complaint Committee of the Medical Disciplinary Board. The Committee decides whether to forward the case for prosecution or to close it, and medical cases cannot be closed without board approval.<\/p>\r\n<p>This peer-review layer is a feature of the Illinois system. At the end of the hearing the ALJ enters a recommended decision, which is then reviewed by the Medical Disciplinary Board.<\/p>\r\n<h2>Who makes the final decision \u2014 and how long it takes<\/h2>\r\n<p>The Medical Disciplinary Board reviews the ALJ's recommendation and may affirm or reject it, then forwards its own recommendation to the Director of the Division. The Director issues the final order, and has the ultimate authority to decide the case \u2014 including, in some instances, reaching a different conclusion from the Board. A physician who disagrees with the final order may seek review under the Administrative Review Law in the circuit court.<\/p>\r\n<p>There is no fixed timeline. A matter closed at investigation may be over in months; a contested case running through a formal complaint, hearing, Board review and a final order can take well over a year, with any appeal longer still.
