Within OP, the <strong>Office of Professional Discipline (OPD)<\/strong> investigates and prosecutes professional misconduct. The <strong>State Board for Nursing<\/strong> is the professional board that assists the process, and the <strong>Board of Regents<\/strong> is responsible for the final disposition of all disciplinary matters. The governing law is <strong>Education Law, Title VIII<\/strong>, with the definitions of misconduct and the penalties set out in sections 6509 through 6511.<\/p>\r\n\r\n    <h2>Who can file a complaint?<\/h2>\r\n    <p>The short answer is almost anyone. Patients and their families file complaints, but so do employers, supervisors and colleagues &mdash; and in nursing, a great many cases begin at work, through an incident report, a termination, or a hospital&rsquo;s own reporting obligation. Other agencies feed in too: the Department of Health refers facility-level findings, and the Attorney General notifies OPD when a professional is convicted of a crime or implicated in Medicaid fraud. Complaints can even be made anonymously, though a complaint too thin to act on may be closed.<\/p>\r\n    <p>Two practical points. First, complaints must be <strong>in writing and signed<\/strong> &mdash; OPD does not take them by phone. Second, some things are outside OP&rsquo;s authority: it will not referee a fee dispute, although it will investigate <em>fraudulent<\/em> billing.<\/p>\r\n\r\n    <h2>What counts as professional misconduct?<\/h2>\r\n    <p>Education Law &sect;6509 and the Regents&rsquo; rules (Part 29 of Title 8 NYCRR) define roughly forty categories of professional misconduct. For nurses, the ones that recur include:<\/p>\r\n    <ul>\r\n      <li>Gross negligence or gross incompetence on a single occasion, or negligence or incompetence on more than one occasion.<\/li>\r\n      <li>Practising while impaired by alcohol or other drugs.<\/li>\r\n      <li>Inaccurate or falsified documentation, or accessing records without authorization.<\/li>\r\n      <li>Unauthorized disclosure of confidential patient information.<\/li>\r\n      <li>Practising beyond the lawful scope of the license, or aiding unlicensed practice.<\/li>\r\n      <li>Patient abandonment or neglect, and physical or verbal abuse of a patient.<\/li>\r\n      <li>Being convicted of a crime, or moral unfitness to practise.<\/li>\r\n    <\/ul>\r\n\r\n    <h2>What follows a complaint<\/h2>\r\n    <p>Once a complaint is received, it is assigned to an <strong>OPD investigator<\/strong> at one of the regional offices. The investigator contacts the complainant for detail, gathers records, and &mdash; at some point &mdash; writes to you, the nurse, to request documents or to schedule an <strong>interview<\/strong>. That letter is a pivotal moment. It is tempting to &ldquo;just explain&rdquo; and clear things up, but the interview is part of a disciplinary investigation, and what you say can be used in later proceedings.<\/p>\r\n\r\n    <div class=\"note\">\r\n      <span class=\"note-h\">Before you respond<\/span>\r\n      <p>Do not attend an OPD interview unrepresented. Vet and retain a New York nursing-license defense attorney first, then respond within the stated deadline &mdash; missing it can lead to a default finding. Preserve your records exactly as they are, avoid giving statements to an employer&rsquo;s HR or administration without advice, and check whether your professional liability policy covers license-defense counsel.<\/p>\r\n    <\/div>\r\n\r\n    <h2>Where a complaint can go from here<\/h2>\r\n    <p>Not every complaint becomes a public case. After investigation, a matter may be <strong>dismissed<\/strong>, resolved <strong>informally<\/strong> for minor or technical issues (a private admonishment that is not publicly reported), or referred for <strong>formal charges<\/strong>.
