Ignoring it is the worst move: <strong>no response within 21 days means the case proceeds by default<\/strong>, without your input.<\/p>\r\n\r\n    <h2>Your choice: formal, informal, or settle<\/h2>\r\n    <p>The Election of Rights sets out your options:<\/p>\r\n    <ul>\r\n      <li><strong>Dispute the facts<\/strong> &rarr; a <strong>formal hearing at the Division of Administrative Hearings (DOAH)<\/strong> before an administrative law judge, who issues a <strong>Recommended Order<\/strong>.<\/li>\r\n      <li><strong>Don&rsquo;t dispute the facts<\/strong> &rarr; an <strong>informal hearing before the Board<\/strong> to argue the penalty.<\/li>\r\n      <li><strong>Settle<\/strong> &rarr; a negotiated <strong>settlement (consent) agreement<\/strong> with the prosecutor, which the Board must approve.<\/li>\r\n      <li><strong>Voluntarily relinquish<\/strong> the licence (which counts as discipline if a complaint is open).<\/li>\r\n    <\/ul>\r\n    <p>After a DOAH hearing, the <strong>Board issues the Final Order<\/strong>. The Board generally <strong>cannot overturn the judge&rsquo;s findings of fact<\/strong> unless they are not supported by competent, substantial evidence, though it sets the penalty within the guideline range.<\/p>\r\n\r\n    <h2>The range of penalties<\/h2>\r\n    <p>Penalties follow the Board&rsquo;s <strong>disciplinary guidelines (Rule 64B9-8.006)<\/strong>, which set a range for each violation. They include a <strong>reprimand<\/strong>, an <strong>administrative fine<\/strong>, <strong>continuing education<\/strong> (the Board&rsquo;s preferred remedy for unprofessional conduct or recordkeeping lapses), <strong>probation<\/strong> with conditions (supervision, reports, appearances), <strong>IPN evaluation and treatment<\/strong>, <strong>suspension<\/strong>, and <strong>revocation<\/strong> &mdash; plus the <strong>costs<\/strong> of investigation and prosecution. For impairment, a typical minimum is a fine, suspension and IPN evaluation.<\/p>\r\n\r\n    <h2>How mitigation moves the outcome<\/h2>\r\n    <p>The Board may <strong>deviate from the guideline range only on aggravating or mitigating circumstances shown by clear and convincing evidence<\/strong>, and these must be put forward before the penalty is set. Mitigating factors include the steps you have taken to correct or stop the problem, insight, remediation and continuing education. This is exactly where a well-built record &mdash; started during the investigation &mdash; changes the result.<\/p>\r\n\r\n    <h2>IPN as part of the picture<\/h2>\r\n    <p>In impairment matters, the Board can order <strong>IPN evaluation and monitoring<\/strong> alongside or instead of other discipline. Engaging early and complying fully is often the strongest path back to safe practice &mdash; but IPN is demanding, and advice before you commit is essential.<\/p>\r\n\r\n    <h2>After the Final Order &mdash; and beyond Florida<\/h2>\r\n    <p>Probation is monitored by the Board; a <strong>revoked licence can be reinstated<\/strong> later on a petition showing rehabilitation.
