The investigator gathers records, interviews witnesses and may seek your statement. A crucial point: <strong>you are not required to give an investigator a statement<\/strong>, and you should not do so &mdash; written or oral &mdash; without advice. Have your attorney request the <strong>complete investigative file<\/strong> so you can see exactly what the Probable Cause Panel will consider.<\/p>\r\n\r\n    <h2>The Probable Cause Panel &mdash; the decisive step<\/h2>\r\n    <p>When the investigation is complete, DOH submits its report to the Board&rsquo;s <strong>Probable Cause Panel<\/strong> (Board members, including nursing professionals). The panel decides whether there is <strong>probable cause<\/strong> that you violated the law. Your best chance to end the case is <strong>here, or before<\/strong>: neither you nor your counsel may address the panel in person, but <strong>DOH must present the written rebuttal you submit<\/strong>. A finding of <strong>no probable cause closes the case<\/strong> (confidentially); a finding of <strong>probable cause means an Administrative Complaint is filed<\/strong> and the matter becomes public.<\/p>\r\n\r\n    <h2>How long it takes<\/h2>\r\n    <p>DOH is directed to complete its investigation and probable-cause recommendation <strong>within about six months<\/strong>. Complex cases take longer, and a missed deadline is generally treated as harmless error unless it actually prejudiced you.<\/p>\r\n\r\n    <h2>The standard of proof<\/h2>\r\n    <p>To discipline you, the Board must prove the violation by <strong>clear and convincing evidence<\/strong> &mdash; a demanding standard, higher than the &ldquo;preponderance&rdquo; used in some states, and the same high bar California applies. That is one reason a well-documented defence can succeed.<\/p>\r\n\r\n    <h2>Emergency suspension<\/h2>\r\n    <p>Where the DOH believes a nurse poses an <strong>immediate, serious danger<\/strong> to the public, the State Surgeon General can issue an <strong>Emergency Suspension Order (ESO)<\/strong> &mdash; or a restriction order &mdash; that takes effect <strong>at once<\/strong>, before the usual process. An ESO is not the end; it can be challenged, but it demands immediate legal help.<\/p>\r\n\r\n    <h2>Impairment and the IPN<\/h2>\r\n    <p>Where the concern is <strong>impairment<\/strong> &mdash; substance use, or a mental or physical condition affecting safe practice &mdash; the case may involve the <strong>Intervention Project for Nurses (IPN)<\/strong>, Florida&rsquo;s confidential monitoring programme and the first nurse diversion programme in the country. A nurse can even <strong>self-refer to IPN and be monitored without the Board being notified<\/strong>. IPN is a genuine alternative to discipline, but it is demanding &mdash; evaluation, treatment and often a multi-year monitoring contract &mdash; and completing it does not by itself guarantee your licence. Take advice before agreeing to an IPN evaluation.<\/p>\r\n\r\n    <h2>Where an investigation leads<\/h2>\r\n    <p>An investigation ends in <strong>closure<\/strong> (no probable cause), a <strong>letter of guidance<\/strong> for a minor first issue, or a <strong>finding of probable cause and an Administrative Complaint<\/strong>.
