The governing law is the <strong>Nurse Practice Act (Chapter 464, Florida Statutes)<\/strong> and the general health-professions law (<strong>Chapter 456<\/strong>), with the Board&rsquo;s rules in Chapter 64B9 of the Florida Administrative Code. The Board regulates RNs, LPNs and APRNs (including certified nurse midwives). DOH first checks <strong>legal sufficiency<\/strong>: does the complaint allege a violation of the Nurse Practice Act by a licensee? Complaints about <strong>fee disputes, personality conflicts or bedside manner<\/strong> are generally not pursued. If it is legally sufficient, an investigation opens.<\/p>\r\n\r\n    <h2>The letter &mdash; and your 20 days<\/h2>\r\n    <p>You will typically first hear via a <strong>letter from a DOH Investigation Specialist<\/strong> saying a complaint has been received and an investigation opened. It will ask for a <strong>written response, usually within about 20 days<\/strong>, and cite the complaint number. This first response matters &mdash; a careful, accurate reply (ideally reviewed by counsel) is your best early chance to resolve the matter. Your attorney can also <strong>request the full investigative file<\/strong>.<\/p>\r\n    <aside class=\"note wb\"><p><span class=\"note-h\">Before you talk<\/span>Investigators may say you don&rsquo;t need a lawyer, or that it is &ldquo;just a quick chat.&rdquo; Everything you say can become part of the record. It is entirely reasonable &mdash; and wise &mdash; to say you&rsquo;ll respond through your attorney.<\/p><\/aside>\r\n\r\n    <h2>Is it public? The confidentiality rule<\/h2>\r\n    <p>Here Florida gives real protection: a complaint and the whole investigation stay <strong>confidential until 10 days after a Probable Cause Panel determines a violation occurred<\/strong> (or you waive confidentiality). If the case is <strong>closed without probable cause, it remains confidential<\/strong> and never appears on your public record.<\/p>\r\n\r\n    <h2>What happens after you respond<\/h2>\r\n    <p>DOH aims to complete its investigation and a probable-cause recommendation <strong>within about six months<\/strong>. It then submits its report to the Board&rsquo;s <strong>Probable Cause Panel<\/strong>, which decides whether there is probable cause of a violation. <strong>No probable cause &rarr; the case is closed.<\/strong> <strong>Probable cause &rarr; DOH files an Administrative Complaint<\/strong> (which becomes public), and the case moves to the disciplinary stage.<\/p>\r\n\r\n    <h2>How far back can a complaint reach?<\/h2>\r\n    <p>Florida applies a <strong>6-year statute of limitations<\/strong>, generally running from the <strong>last date of treatment<\/strong>.
