don&rsquo;t see coming: the pre-charge interview. Investigators interview the complainant, you, and others with relevant knowledge, and may request records or conduct a <strong>site visit<\/strong>. You must cooperate and produce relevant records &mdash; but you should do so on advice.<\/p>\r\n\r\n    <h2>The pre-charge interview &mdash; the pivotal step<\/h2>\r\n    <p>Before a case is referred to the Board, you have the <strong>right to be interviewed<\/strong> to explain your position (PHL &sect;230(10)). Crucially: <strong>the interview is voluntary &mdash; you may decline it &mdash; and you may have your attorney present<\/strong> (and bring a stenographer at your own expense). This is often described as the single most dangerous point in the process: investigators may encourage you to talk without a lawyer and suggest you have &ldquo;nothing to worry about.&rdquo; Well prepared and represented, the interview can be your best chance to close the case; unprepared, it can sink it. <strong>Never attend without counsel.<\/strong><\/p>\r\n    <aside class=\"note\"><p><span class=\"note-h\">Do not go alone<\/span>The pre-charge interview feels informal, but what you say shapes whether the case is referred for charges. Prepare thoroughly with your attorney, and take up the right to have counsel &mdash; and a stenographer &mdash; present.<\/p><\/aside>\r\n\r\n    <h2>The Investigation Committee<\/h2>\r\n    <p>The case is then presented to an <strong>Investigation Committee &mdash; two physicians and one lay member<\/strong>. The committee can recommend a <strong>hearing<\/strong>, <strong>further investigation<\/strong>, <strong>dismissal<\/strong>, or a <strong>non-disciplinary warning<\/strong>. If it recommends charges, a DOH attorney prepares a <strong>Notice of Hearing and Statement of Charges<\/strong>.<\/p>\r\n\r\n    <h2>The standard of proof<\/h2>\r\n    <p>To sustain charges, OPMC must prove misconduct by a <strong>preponderance of the evidence<\/strong> &mdash; &ldquo;more likely than not.&rdquo; That is lower than the clear-and-convincing standard used in states like California and Florida, which makes an organised, well-evidenced response important even on a seemingly weak case.<\/p>\r\n\r\n    <h2>Impairment and the Committee for Physician Health<\/h2>\r\n    <p>Where the concern is <strong>impairment<\/strong> &mdash; alcohol, drugs or a mental-health condition &mdash; New York has the <strong>Committee for Physician Health (CPH)<\/strong>, a <strong>confidential, non-disciplinary<\/strong> programme run by the Medical Society of the State of New York under contract with OPMC. A physician whose ability to practise is not currently impaired but who needs help can be <strong>referred to CPH confidentially<\/strong>, and engaging early can keep a health issue out of the disciplinary track.
