Settlement Conference &mdash; largely determines what happens to your licence. The first is your <strong>written response within 28 days<\/strong> of the notice letter &mdash; the reply that closes nearly 40&#37; of complaints. The second, if the case proceeds, is the <strong>Informal Settlement Conference (ISC)<\/strong>, where you appear before a board panel. Prepare both as if they decide the case, because they often do.<\/p>\r\n\r\n    <h2>The Informal Settlement Conference<\/h2>\r\n    <p>The ISC is a <strong>non-public hearing in Austin<\/strong> before at least one physician and one public board member. You receive the panel&rsquo;s material 45 days beforehand and may bring counsel and witnesses. At the end the panel may <strong>dismiss<\/strong>, recommend a <strong>remedial plan<\/strong> or an <strong>agreed order<\/strong>, call for <strong>more investigation<\/strong>, or refer the case to <strong>SOAH<\/strong> or to a <strong>temporary suspension<\/strong> hearing. About a quarter of cases are dismissed here.<\/p>\r\n\r\n    <h2>Remedial plans and agreed orders<\/h2>\r\n    <p>For lower-level issues the Board may offer a <strong>remedial plan<\/strong> &mdash; a <strong>non-disciplinary<\/strong> resolution (for example, education or a practice change) that resolves the complaint without a finding of a violation, though it is <strong>public record<\/strong>. For more serious matters the outcome is an <strong>agreed order<\/strong>: a negotiated settlement with specific terms such as CME, monitoring, chart review, practice restrictions, an <strong>administrative penalty<\/strong> (fine), or a public reprimand. An agreed order is discipline, is <strong>permanent public record<\/strong>, and is reported to the <strong>National Practitioner Data Bank<\/strong>.<\/p>\r\n\r\n    <h2>If there&rsquo;s no agreement: SOAH<\/h2>\r\n    <p>If you can&rsquo;t reach an agreed resolution, the Board files the case at the <strong>State Office of Administrative Hearings (SOAH)<\/strong>. After discovery, an administrative law judge holds a contested hearing and issues a <strong>Proposal for Decision<\/strong> with findings of fact and conclusions of law. A distinctive Texas feature: <strong>the Board cannot change the judge&rsquo;s findings of fact or conclusions of law<\/strong> &mdash; but the <strong>penalty is the Board&rsquo;s to decide<\/strong>. The Board then issues a final order; you may request a rehearing and, after that, seek judicial review in a Travis County district court.<\/p>\r\n\r\n    <h2>The range of outcomes<\/h2>\r\n    <ul>\r\n      <li><strong>Dismissal.<\/strong><\/li>\r\n      <li><strong>Non-disciplinary remedial plan<\/strong> (public, but not a finding of violation).<\/li>\r\n      <li><strong>Agreed order<\/strong> with terms &mdash; CME, monitoring, chart review, restrictions, administrative penalty, public reprimand.<\/li>\r\n      <li><strong>Suspension or restriction<\/strong> of the licence &mdash; including <strong>temporary suspension<\/strong> where continued practice poses a continuing threat.<\/li>\r\n      <li><strong>Revocation<\/strong>, or voluntary <strong>surrender<\/strong>.<\/li>\r\n    <\/ul>\r\n\r\n    <h2>Where impairment fits<\/h2>\r\n    <p>Where the real issue is physical or mental impairment or substance use, the matter may be handled through the confidential <strong>Texas Physician Health Program<\/strong> &mdash; evaluation, treatment and monitoring &mdash; rather than public discipline, provided you engage and comply.<\/p>\r\n\r\n    <h2>Where mitigation moves the outcome<\/h2>\r\n    <p>Across all of this, <strong>mitigation moves cases<\/strong>. Demonstrated insight, completed CME and remediation, corrective changes to your practice, and evidence that the underlying problem is fixed can turn an agreed order into a remedial plan, or a harsh set of terms into a lighter one.
