A copy goes to you and to the complainant. The &ldquo;prayer&rdquo; often seeks revocation, but that is the opening position, not the usual result.<\/p>\r\n\r\n    <h2>The 15-day deadline<\/h2>\r\n    <p>You have <strong>15 days from service to file a Notice of Defense<\/strong> to obtain a hearing. Miss it and the Board can take a <strong>default decision<\/strong> and discipline you &mdash; up to revoking your licence &mdash; without a hearing. It is the most important deadline in the process.<\/p>\r\n    <aside class=\"note\"><p><span class=\"note-h\">Act now<\/span>If an Accusation has arrived, contact a California psychology licence-defence attorney immediately &mdash; well inside the 15 days &mdash; and notify your insurer.<\/p><\/aside>\r\n\r\n    <h2>Settle or be heard<\/h2>\r\n    <p>Most cases resolve by a <strong>stipulated agreement<\/strong> &mdash; a negotiated settlement in which you typically admit some allegations and accept agreed discipline, subject to Board approval. If no settlement is reached, the case goes to a <strong>hearing at the Office of Administrative Hearings<\/strong> before an administrative law judge; the Board, represented by a Deputy Attorney General, must prove its case by <strong>clear and convincing evidence<\/strong>. The judge issues a <strong>Proposed Decision<\/strong> within about 30 days, which the Board can <strong>adopt, modify or reject<\/strong>.<\/p>\r\n\r\n    <h2>The range of outcomes<\/h2>\r\n    <ul>\r\n      <li>Case <strong>closed<\/strong>, or a confidential <strong>educational \/ warning letter<\/strong> (non-disciplinary).<\/li>\r\n      <li><strong>Citation and fine<\/strong> (used for less egregious matters such as advertising violations).<\/li>\r\n      <li><strong>Public reproval.<\/strong><\/li>\r\n      <li><strong>Probation<\/strong> &mdash; the most common disciplinary result &mdash; usually with conditions.<\/li>\r\n      <li><strong>Suspension.<\/strong><\/li>\r\n      <li><strong>Revocation<\/strong>, or <strong>voluntary surrender<\/strong> of the licence.<\/li>\r\n    <\/ul>\r\n    <p>Probation conditions can include practice restrictions, education and ethics coursework, a &sect;820 evaluation, therapy or treatment and monitoring, a practice monitor, and <strong>cost recovery<\/strong> under BPC &sect;125.3.<\/p>\r\n\r\n    <h2>How impairment is handled &mdash; no diversion program<\/h2>\r\n    <p>Where substance use or a mental-health condition is in the picture, note an important difference: <strong>unlike some California boards, the Board of Psychology does not run a confidential diversion programme<\/strong>. Concerns about impairment are addressed within the enforcement process &mdash; through a compelled examination under <strong>BPC &sect;820<\/strong> and, where discipline follows, probation conditions requiring evaluation, treatment and monitoring.
