Its authority comes from the <strong>Psychology Licensing Law<\/strong> (Business &amp; Professions Code &sect;2900 and following), and its purpose is consumer protection. Note that <strong>clinical social workers, marriage and family therapists and professional clinical counsellors<\/strong> are regulated by the separate Board of Behavioral Sciences &mdash; a complaint about one of them is not within the BOP&rsquo;s authority.<\/p>\r\n\r\n    <h2>Who can file &mdash; and what they complain about<\/h2>\r\n    <p>Anyone may file: patients and former patients, family members, employers, colleagues, insurers and other agencies; criminal matters can be referred by law enforcement. Common allegations include <strong>boundary and multiple-role violations<\/strong> (social relationships with patients, lending money to or employing a patient, business ventures), <strong>sexual misconduct<\/strong> (including sexual contact with a current or former patient), <strong>confidentiality breaches<\/strong>, gross negligence or incompetence, practising outside one&rsquo;s field of competence, fraud, and false advertising. Anonymous complaints are reviewed but hard to pursue without documentation.<\/p>\r\n\r\n    <h2>The records release that shapes every case<\/h2>\r\n    <p>Something distinctive to psychology: the Board <strong>cannot obtain treatment information &mdash; and you cannot lawfully discuss a patient&rsquo;s treatment &mdash; without the patient&rsquo;s signed Authorization for Release<\/strong> of Client\/Patient Record Information. Without that Release, the Board often cannot investigate a clinical complaint at all. It reflects the psychotherapist&ndash;patient privilege that governs your records.<\/p>\r\n    <aside class=\"note wb\"><p><span class=\"note-h\">Confidentiality<\/span>Your duty of confidentiality does not switch off because a complaint has been filed. Disclose patient information only as the process lawfully requires &mdash; and take advice if you are unsure what that means in your case.<\/p><\/aside>\r\n\r\n    <h2>What the Board can&rsquo;t act on<\/h2>\r\n    <p>The Board has <strong>no authority over fee or billing disputes, general business practices, or personality conflicts<\/strong>, and none over professionals licensed by other boards. Those complaints are referred elsewhere.<\/p>\r\n\r\n    <h2>Is the complaint public?<\/h2>\r\n    <p>No &mdash; complaints and investigations are <strong>confidential and not public record<\/strong>. They become public only if the Board files a formal <strong>Accusation<\/strong>; accusations and final decisions then appear on the DCA licence search. A closed case leaves no public mark.<\/p>\r\n\r\n    <h2>What follows once a complaint arrives<\/h2>\r\n    <p>You should receive <strong>acknowledgement within about 10 days<\/strong>. The complaint is assigned a case number, an analyst confirms jurisdiction and &mdash; with the patient&rsquo;s Release &mdash; requests your response and records, and an <strong>expert case reviewer<\/strong> may evaluate the care. From there the analyst either <strong>closes<\/strong> the case or forwards it to a <strong>field investigator<\/strong>. Minor matters may be handled by mediation, a confidential warning or educational letter, an educational conference, or a citation and fine; serious allegations (sexual abuse, gross negligence, incompetence) are referred for formal investigation.<\/p>\r\n\r\n    <h2>The first steps that protect you<\/h2>\r\n    <ul>\r\n      <li><strong>Preserve your records exactly<\/strong> &mdash; notes, correspondence, billing.
