can change the outcome. The Accusation is a <strong>public record<\/strong>, and its &ldquo;prayer&rdquo; often asks for revocation &mdash; but <strong>revocation is usually reserved for the most egregious conduct<\/strong>. Cases are prosecuted by the Attorney General&rsquo;s Health Quality Enforcement Section.<\/p>\r\n\r\n    <h2>The 15-day deadline<\/h2>\r\n    <p>Once served with an Accusation, you have <strong>15 days to file a Notice of Defense<\/strong> to obtain a hearing. Miss it and the Board can enter a <strong>Default Decision and revoke your licence<\/strong> without ever hearing your side. It is the most important deadline in the process. <strong>Do not let it pass.<\/strong><\/p>\r\n    <aside class=\"note\"><p><span class=\"note-h\">Act now<\/span>If an Accusation has arrived, contact a California dental licence-defence attorney immediately &mdash; well inside the 15 days &mdash; and notify your insurer.<\/p><\/aside>\r\n\r\n    <h2>Settle or be heard<\/h2>\r\n    <p>Most cases resolve without a full hearing. A <strong>stipulated settlement<\/strong> is a negotiated agreement (probation, public reproval or surrender) subject to Board approval. If no settlement is reached, the case goes to a <strong>hearing at the Office of Administrative Hearings<\/strong> before an administrative law judge, with the Board represented by a Deputy Attorney General. The judge issues a <strong>proposed decision<\/strong>, which the Board can then <strong>adopt, modify or reject<\/strong>.<\/p>\r\n\r\n    <h2>The range of penalties<\/h2>\r\n    <ul>\r\n      <li><strong>Letter of Education<\/strong> or an <strong>administrative citation and fine<\/strong> (a citation is not itself &ldquo;discipline&rdquo;).<\/li>\r\n      <li><strong>Public reproval \/ reprimand.<\/strong><\/li>\r\n      <li><strong>Probation<\/strong> &mdash; the most common outcome &mdash; usually a revocation that is &ldquo;stayed&rdquo; while you complete the conditions.<\/li>\r\n      <li><strong>Suspension.<\/strong><\/li>\r\n      <li><strong>Revocation<\/strong>, or <strong>voluntary surrender<\/strong> of the licence.<\/li>\r\n    <\/ul>\r\n    <p>Probation conditions can include remedial education, courses, a psychological evaluation and therapy, a practice monitor or approved supervisor, abstention and testing where substance use is involved, and <strong>cost recovery<\/strong> under BPC &sect;125.3.<\/p>\r\n\r\n    <h2>Remedial education and mitigation<\/h2>\r\n    <p>For negligence or incompetence the guidelines lean heavily on <strong>remedial education<\/strong>, usually required before you return to the deficient area of practice (note that ordinary renewal CE does <strong>not<\/strong> count toward it). Within the guidelines, <strong>mitigation moves outcomes<\/strong> &mdash; demonstrated insight, completed remediation, corrective changes to your practice, and dated references from colleagues (signed under penalty of perjury) can shift a case from revocation toward probation and lighten the terms.<\/p>\r\n\r\n    <h2>The Diversion Program<\/h2>\r\n    <p>Where the real issue is <strong>drug or alcohol impairment<\/strong>, the Board&rsquo;s <strong>Diversion Program<\/strong> offers a <strong>confidential<\/strong> route into evaluation, treatment and monitoring; entering and completing it can help you avoid or resolve discipline. It is demanding, it can be ordered as a condition of probation, and its records can be used against you if you fail to comply or are deemed a threat to the public &mdash; so weigh the decision with advice.<\/p>\r\n\r\n    <h2>After a decision<\/h2>\r\n    <p>If you are placed on probation, the Board&rsquo;s <strong>Probation Unit<\/strong> monitors compliance, and you can later <strong>petition to modify or end probation early<\/strong>. You keep appeal rights &mdash; a <strong>Petition for Reconsideration<\/strong> before the decision takes effect and a <strong>Petition for Writ of Mandate<\/strong> in the Superior Court (Code Civ. Proc. &sect;1094.5). A <strong>revoked or surrendered licence can be reinstated<\/strong> on a later petition (generally no sooner than three years) showing rehabilitation.
