The Board may also <strong>inspect your premises<\/strong> (BPC &sect;1670); refusing an inspection can itself lead to suspension or revocation.<\/p>\r\n\r\n    <h2>The notice letter &mdash; and your written response<\/h2>\r\n    <p>You will usually receive a <strong>formal letter asking for a written response<\/strong>, commonly around <strong>30 days<\/strong> from the mailing date. This is the most consequential window in the whole process: the content of your response, together with a mitigation bundle, shapes every later stage. <strong>Take advice before you send it.<\/strong> You may be asked to provide records voluntarily; investigators can also compel them.<\/p>\r\n    <aside class=\"note\"><p><span class=\"note-h\">Records to expect<\/span>Investigators typically gather the chart, radiographs, photographs, models, treatment plans and billing records, and may interview witnesses. Never alter a record; produce documents through your attorney where possible.<\/p><\/aside>\r\n\r\n    <h2>How long does it take?<\/h2>\r\n    <p>Investigations commonly take <strong>6 to 18 months<\/strong>. Cases that go to a contested hearing can run <strong>well beyond 36 months<\/strong> to a Final Decision. While the case is open it stays <strong>confidential<\/strong>, and most dentists continue to practise unless an <strong>Interim Suspension Order<\/strong> is issued.<\/p>\r\n\r\n    <h2>The standard of proof<\/h2>\r\n    <p>To discipline you, the Board must prove a violation by <strong>clear and convincing evidence to a reasonable certainty<\/strong> &mdash; higher than the civil &ldquo;more likely than not&rdquo; test, though lower than the criminal standard. In quality-of-care cases, the <strong>dental consultant&rsquo;s or expert&rsquo;s opinion<\/strong> is usually decisive.<\/p>\r\n\r\n    <h2>The statute of limitations<\/h2>\r\n    <p>Here dentistry differs from nursing and pharmacy, which have none. Under <strong>BPC &sect;1670.2<\/strong>, an Accusation for a practice violation must generally be filed <strong>within three years after the Board discovers<\/strong> the act, or <strong>within seven years after it occurred<\/strong>, whichever comes first. But the exceptions are wide: <strong>no limit<\/strong> for fraud or willful misrepresentation, or for incompetence or negligence that was <strong>intentionally concealed<\/strong>; a longer window (up to ten years) for certain sexual-misconduct allegations; and tolling &mdash; for example while you are out of state or participating in the diversion program. Don&rsquo;t assume an old matter is time-barred.<\/p>\r\n\r\n    <h2>Can I keep working during the investigation?<\/h2>\r\n    <p>Usually yes. In serious cases the Board can seek an <strong>Interim Suspension Order<\/strong>, and a criminal court can restrict practice under <strong>Penal Code &sect;23<\/strong> while a related prosecution is pending &mdash; but most dentists keep working while an investigation runs.<\/p>\r\n\r\n    <h2>Where an investigation leads<\/h2>\r\n    <p>An investigation ends by being <strong>closed<\/strong> (no violation &mdash; nothing published), resolved with a <strong>Letter of Education<\/strong> or an <strong>administrative citation and fine<\/strong> (BPC &sect;125.9 &mdash; used where there is no physical harm but the care was substandard, and which may include an order to correct), or referred to the <strong>Attorney General<\/strong> for a formal <strong>Accusation<\/strong>.
