Accusations are <strong>published on the Board&rsquo;s website<\/strong> and typically ask for revocation and for <strong>recovery of the Board&rsquo;s investigation and prosecution costs<\/strong>.<\/p>\r\n\r\n    <h2>The 15-day deadline you cannot miss<\/h2>\r\n    <p>Once served with an Accusation, you have <strong>15 days to file a Notice of Defense<\/strong> to obtain a hearing. This is the most important deadline in the whole process: <strong>failing to respond to an Accusation is itself the most serious (Category IV) violation in the Board&rsquo;s guidelines, for which the recommended penalty is revocation<\/strong>. Miss the deadline and the Board can take your licence by default. Do not let that happen.<\/p>\r\n    <aside class=\"note\"><p><span class=\"note-h\">Act immediately<\/span>If an Accusation has arrived, contact a California pharmacist licence-defence attorney straight away &mdash; well within the 15 days &mdash; and notify your insurer.<\/p><\/aside>\r\n\r\n    <h2>Settle or be heard<\/h2>\r\n    <p>Most cases resolve without a full hearing. A <strong>stipulated settlement<\/strong> is a negotiated agreement with the Attorney General, subject to Board approval, that usually results in some form of probation. If no settlement is reached, the case goes to a <strong>hearing at the Office of Administrative Hearings<\/strong> before an administrative law judge, with the Board represented by a Deputy Attorney General. The judge issues a decision, generally <strong>within 30 days<\/strong>, which the Board then reviews and adopts, modifies or rejects.<\/p>\r\n\r\n    <h2>How penalties are set: four categories<\/h2>\r\n    <p>The Board&rsquo;s <strong>Disciplinary Guidelines<\/strong> sort violations into four categories, from least to most serious, each with a recommended minimum and maximum penalty:<\/p>\r\n    <ul>\r\n      <li><strong>Category I<\/strong> &mdash; minimum of revocation stayed with about <strong>two years&rsquo; probation<\/strong>; maximum revocation.<\/li>\r\n      <li><strong>Category III<\/strong> &mdash; minimum of revocation stayed with roughly <strong>90 days&rsquo; actual suspension and three to five years&rsquo; probation<\/strong> (for example, controlled-substance dispensing failures, or dispensing without a valid prescription).<\/li>\r\n      <li><strong>Category IV<\/strong> &mdash; <strong>revocation<\/strong>, for the most serious matters (drug diversion, repeated or serious violations, or failing to respond to an Accusation).<\/li>\r\n    <\/ul>\r\n    <p>Standard probation conditions include obeying all laws, reporting specified events in writing, quarterly reports and periodic interviews with the Board, cost recovery, and &mdash; where substance use is involved &mdash; drug testing and treatment. The Board weighs aggravating and mitigating factors and may depart from the guidelines where the circumstances justify it.<\/p>\r\n\r\n    <h2>Where mitigation moves the outcome<\/h2>\r\n    <p>Within those categories, <strong>mitigation is what moves a case<\/strong> &mdash; from revocation toward probation, or toward shorter and lighter terms. Demonstrated insight, completed remediation and education, evidence that the underlying issue is fixed, and supportive references all count. Building that record early, during the investigation, pays off here.<\/p>\r\n\r\n    <h2>The Pharmacists Recovery Program<\/h2>\r\n    <p>Where the real issue is <strong>chemical dependency or mental illness<\/strong>, the <strong>Pharmacists Recovery Program (PRP)<\/strong> offers a <strong>confidential<\/strong> route into evaluation, treatment and monitoring. Voluntary self-referrals are strictly confidential and not subject to discovery or subpoena; the Board also uses the programme for impaired licensees. It is demanding and not right for everyone &mdash; and enrolment does not automatically end a disciplinary case &mdash; but for many it is the path back to safe practice.<\/p>\r\n\r\n    <h2>After a decision<\/h2>\r\n    <p>If you are placed on probation, a Board monitor oversees compliance, and you can later <strong>petition to modify or end probation early<\/strong>.
