Its authority comes from the <strong>Pharmacy Law<\/strong> (Business &amp; Professions Code &sect;4000 and following), and its overriding mandate is to protect the public &mdash; enforcing standards on everything from prescription accuracy and patient counselling to controlled-substance handling and record-keeping.<\/p>\r\n\r\n    <h2>What the Board treats as misconduct<\/h2>\r\n    <p>Complaints commonly concern <strong>dispensing errors<\/strong> (wrong drug, wrong strength, wrong directions), failure to counsel a patient on a new or changed prescription, allowing a non-pharmacist to counsel a patient or fill a prescription, practising while impaired, controlled-substance and CURES violations, and record-keeping failures. The Board asks that suspected errors and misconduct be reported <strong>whether or not a patient was harmed<\/strong>.<\/p>\r\n    <aside class=\"note wb\"><p><span class=\"note-h\">Board inspectors<\/span>The Board&rsquo;s inspectors are sworn peace officers. Complaints can be filed on the Board&rsquo;s online complaint form or by mail, and they are <strong>confidential<\/strong>.<\/p>\r\n\r\n    <h2>What is outside the Board&rsquo;s reach<\/h2>\r\n    <p>The Board acts only where a pharmacist, pharmacy or firm it regulates may have violated Pharmacy Law. It generally does <strong>not<\/strong> have jurisdiction over <strong>drug prices, insurance or billing disputes, or pure customer-service complaints<\/strong>. Matters involving other professionals or facilities are referred to the appropriate agency.<\/p>\r\n\r\n    <h2>How the Board evaluates a complaint<\/h2>\r\n    <p>Each complaint is first reviewed to confirm it involves a licensee and a possible violation of Pharmacy Law. From there it may be <strong>closed<\/strong> (no jurisdiction or no violation), resolved informally (for example, an <strong>official warning, a citation and fine, or a consent agreement<\/strong>), referred to the confidential <strong>Pharmacists Recovery Program<\/strong> where impairment is the concern, or opened for <strong>investigation<\/strong>. Routine investigations often take around <strong>six months<\/strong>; complex ones take longer.<\/p>\r\n\r\n    <h2>Is the complaint public?<\/h2>\r\n    <p>Not at this stage. The investigation is <strong>confidential and not shared publicly<\/strong> unless and until the Board files a formal <strong>Accusation<\/strong> or imposes discipline.
