The Board has been criticised in the past for delay; in its most recent sunset review it reported averaging around <strong>22 months<\/strong> to resolve consumer complaints. While a case is open, staff <strong>cannot give status updates<\/strong>, and a long wait is not a signal either way.<\/p>\r\n    <aside class=\"note\"><p><span class=\"note-h\">Context<\/span>The BRN receives about 7,500 complaints a year. A referral to investigation is a long way from a finding &mdash; many investigations close with no action.<\/p><\/aside>\r\n\r\n    <h2>The investigative interview<\/h2>\r\n    <p>Most investigations involve an interview in which the investigator asks for your account. A few things every nurse should know:<\/p>\r\n    <ul>\r\n      <li>You <strong>can, and should, bring an attorney.<\/strong> There is no downside, and a great deal at stake.<\/li>\r\n      <li>What you say is <strong>on the record<\/strong> and can be used later; a careful, prepared account matters more than a quick one.<\/li>\r\n      <li>Questioning often <strong>ranges beyond the original complaint<\/strong> &mdash; into your wider practice, documentation or health &mdash; so prepare for the whole picture.<\/li>\r\n    <\/ul>\r\n\r\n    <h2>Records and cooperation<\/h2>\r\n    <p>Investigators gather patient charts, personnel files and other records from the relevant sources, and can compel them by subpoena. Two rules protect you: <strong>never alter a record<\/strong> after the fact, and <strong>route document requests through your attorney<\/strong> where possible. Remember too that a nurse must <strong>report criminal convictions<\/strong> to the Board &mdash; failing to disclose one is itself a ground for discipline.<\/p>\r\n\r\n    <h2>The standard of proof<\/h2>\r\n    <p>If the case proceeds to a hearing, the Board must prove its case by <strong>clear and convincing evidence<\/strong> &mdash; a materially higher standard than the &ldquo;more likely than not&rdquo; test in a civil malpractice suit, though lower than the criminal &ldquo;beyond a reasonable doubt.&rdquo; That is why an expert&rsquo;s view on the standard of care so often decides whether a matter goes forward.<\/p>\r\n\r\n    <h2>Can the Board stop me working in the meantime?<\/h2>\r\n    <p>Usually not &mdash; most nurses keep practising throughout an investigation. In serious cases the Board can seek an <strong>Interim Suspension Order<\/strong> from an administrative law judge where the evidence shows that continued practice would endanger the public. Separately, under <strong>Penal Code &sect;23<\/strong>, a criminal court can restrict or suspend a nurse&rsquo;s practice while a related prosecution is pending.<\/p>\r\n\r\n    <h2>How far back can the Board reach? No statute of limitations<\/h2>\r\n    <p>This is where nursing differs sharply from medicine. The Medical Board must generally file within three to seven years; the <strong>BRN has no statute of limitations at all<\/strong>. Allegations from many years ago &mdash; and even matters the Board previously closed &mdash; can be revisited and used to seek discipline. It is one reason a thorough, well-documented response early on is so valuable.<\/p>\r\n\r\n    <h2>Where an investigation leads<\/h2>\r\n    <p>An investigation ends in one of three broad ways: the case is <strong>closed<\/strong> (no violation, or none serious enough to pursue &mdash; and nothing is published); it is resolved by an informal <strong>citation and fine<\/strong> for a minor violation (under Cal. Code Regs. tit. 16, &sect;1435.2 the fine generally runs from $0 to $2,500, and up to $5,000 in certain circumstances); or, where the evidence substantiates a violation, it is referred to the <strong>Attorney General<\/strong> to file a formal <strong>Accusation<\/strong>.
