Simpler matters may stay with the Board&rsquo;s non-sworn Complaint Investigation Office. The Board&rsquo;s own guidance is that, on average, it takes about <strong>one to one-and-a-half years<\/strong> to complete an investigation and file an Accusation, with the post-investigation review by the Attorney General and Board adding roughly 45 days. A straightforward matter that ends in a citation resolves faster; a complex quality-of-care case involving multiple patients and expert review takes longer. Under Bus. &amp; Prof. Code &sect;2234(g), failing to attend within 30 days is <strong>itself unprofessional conduct<\/strong> &mdash; independent grounds for discipline &mdash; and the Board may close or act on the case if you do not respond.<\/li>\r\n    <\/ul>\r\n\r\n    <h2>The subject interview<\/h2>\r\n    <p>The interview is the pivot point of most investigations. A few things every physician should know:<\/p>\r\n    <ul>\r\n      <li>You <strong>can, and should, bring an attorney.<\/strong> There is no downside, and a great deal at stake.<\/li>\r\n      <li>The session is <strong>audio-recorded<\/strong> and the transcript can be introduced as evidence; an expert reviewer and a Deputy Attorney General may attend.<\/li>\r\n      <li>Questioning often <strong>expands beyond the original complaint<\/strong> &mdash; to your wider prescribing patterns, health, or hospital credentialing history. Prepare for the whole picture, not just one patient.<\/li>\r\n    <\/ul>\r\n    <p>After the interview, your recorded answers, written summary and the records go back to the expert reviewer, who forms an opinion on whether there is clear and convincing evidence of a violation.<\/p>\r\n\r\n    <h2>The standard of proof<\/h2>\r\n    <p>California administrative cases are decided on <strong>clear and convincing evidence to a reasonable certainty<\/strong> &mdash; a materially higher standard than the &ldquo;more likely than not&rdquo; test in a civil malpractice suit. That is why the expert reviewer&rsquo;s opinion on the standard of care so often decides whether a case proceeds.<\/p>\r\n\r\n    <h2>Can the Board stop me practising in the meantime?<\/h2>\r\n    <p>Only in limited circumstances. If an expert opines that your continued practice would endanger the public, the Board can seek an <strong>Interim Suspension Order<\/strong>. Separately, certain <strong>felony convictions<\/strong> trigger an automatic suspension, with revocation to follow once the conviction is final (you have 30 days to request a hearing on the level of discipline). The statute of limitations<\/h2>\r\n    <p>Under Bus. &amp; Prof. Code &sect;2230.5, an Accusation generally must be filed within the <strong>earlier of three years from when the Board discovers the act, or seven years from the act itself<\/strong>.
