Respond to a CPM Complaint<\/h1>\r\n<div class=\"meta\"><b>9 min read<\/b><span>Last updated July 15, 2026<\/span><\/div>\r\n<p class=\"lede\">A letter from the College of Physiotherapists of Manitoba is an unsettling thing to open. But the Manitoba complaints process runs a defined path under the province&rsquo;s own legislation, and two features shape everything else: the Complaints Committee decides on the written record, not at a hearing &mdash; and failing to respond to the College on time is, by itself, a form of misconduct.<\/p>\r\n<div class=\"callout\"><strong>Before you do anything:<\/strong> a complaint is not a finding of wrongdoing, and most complaints do not end in a discipline hearing. Read the letter, note the deadline, and respond in writing on time &mdash; silence toward the College is its own problem. Notify your professional liability insurer and, where the matter is serious, a regulatory lawyer before you draft a word. Do not alter the patient record, and do not contact the complainant.<\/div>\r\n<h2>Manitoba has its own Act<\/h2>\r\n<p>Physiotherapists in Manitoba are not regulated under umbrella health legislation the way many professions are in other provinces. They have their own statute &mdash; The Physiotherapists Act, C.C.S.M. c. P65 &mdash; which is administered by the College of Physiotherapists of Manitoba (CPM). You practise on a certificate of registration issued by the College, and the Act sets out the complaints and discipline process in detail. Knowing that the rules come from this specific Act, and not from the frameworks you may have read about in Ontario or elsewhere, matters: the committees, the terminology and the review rights are Manitoba&rsquo;s own.<\/p>\r\n\r\n<h2>A complaint is not a finding<\/h2>\r\n<p>Anyone with a concern about a physiotherapist can complain to the College &mdash; a patient, a family member, another professional or a member of the public. The College reviews written complaints about matters such as boundary violations, physical harm, breach of confidentiality and unethical conduct. That a complaint has been opened tells you nothing about the outcome. The majority resolve without a discipline hearing. What the letter requires is a considered, timely, written response &mdash; not panic, and above all not the two moves that make things worse: editing the record or contacting the person who complained.<\/p>\r\n\r\n<h2>The Complaints Committee decides on the written record<\/h2>\r\n<p>Your file is handled by the College&rsquo;s Complaints Committee. An investigator is usually appointed first, and on concluding the investigation the investigator reports their findings to the Complaints Committee. The Committee then decides. Crucially, it is not required to hold a hearing or to take oral submissions at this stage &mdash; but it must give both you and the complainant the opportunity to make a written submission. In practice this means your written response is your case. There is no courtroom moment here in which to explain what you meant; the Committee weighs what is on the page.<\/p>\r\n\r\n<h2>Respond &mdash; and respond on time<\/h2>\r\n<p>Manitoba is unusually explicit about this. Under the College&rsquo;s by-laws and Code, failing to respond to College correspondence within the required time is itself an act of professional misconduct &mdash; a physiotherapist has been disciplined on exactly that basis. Cooperating with the College is a professional obligation, not an optional courtesy. That does not mean answering off the cuff: you can meet every deadline while still taking proper advice on how to frame your response and which records are relevant. If you need more time, ask the College before the deadline passes rather than after.<\/p>\r\n\r\n<h2>What the Complaints Committee can do<\/h2>\r\n<p>After considering the file and the written submissions, the Complaints Committee has a defined set of options under the Act. It can take no action; it can censure you &mdash; but only where at least one member of the Committee has met with you and you have agreed to accept the censure, and where no other action is to be taken; it can refer the matter to mediation, if the complaint is strictly a matter between you and the complainant and both of you agree; it can enter into an agreement with you providing for steps such as an assessment of your capacity or fitness to practise, education or remediation, or conditions on your practice; or it can refer the matter to the Inquiry Committee for a formal discipline hearing. Even after taking another step short of a censure, the Committee can later refer the matter to the Inquiry Committee.<\/p>\r\n\r\n<h2>Interim risk &mdash; suspension or conditions before any finding<\/h2>\r\n<p>Where a physiotherapist&rsquo;s conduct exposes, or is likely to expose, the public to serious risk, the Complaints Committee can direct the registrar to suspend the certificate of registration or place conditions on the practitioner&rsquo;s practice pending the outcome of the proceedings. This is a precaution, not a finding. If it happens to you, the Act gives you a specific remedy: you can apply to the Court of King&rsquo;s Bench for an order staying that interim decision while the process runs its course. This is the point at which legal representation matters most.<\/p>\r\n\r\n<h2>What becomes public<\/h2>\r\n<p>The College maintains a public register, and the results of disciplinary proceedings are published on it &mdash; the register shows the results of every disciplinary proceeding completed within the previous six years. Where a discipline panel makes an order against a member, the College may publish the member&rsquo;s name and the circumstances of the case. Complaints resolved at the Committee stage without a discipline finding do not carry the same publication.
