BC College of Nurses and Midwives<\/p>\r\n<h1>What Happens During a BCCNM Investigation?<\/h1>\r\n<div class=\"meta\"><b>11 min read<\/b><span>Last updated July 14, 2026<\/span><\/div>\r\n<p class=\"lede\">Since 1 April 2026, BCCNM can suspend your practice authority in the middle of an investigation without telling you first and without hearing from you. For a nurse or midwife who works for an employer, that is not a procedural technicality &mdash; it is the end of your income, immediately. And when the process concludes, the appeal route to the courts that existed for thirty years is gone.<\/p>\r\n<div class=\"callout\"><strong>If a summary protection order is made against you, seek advice the same day.<\/strong> And if your employer is investigating the same incident, do not give a statement at work before speaking to your union and CNPS. What you say there can end up in front of the College.<\/div>\r\n<h2>The order that can stop you working tomorrow<\/h2>\r\n<p>Start here, because for a nurse or midwife this is the change that bites hardest.<\/p>\r\n<p>Under sections 259 and 260 of the HPOA, during an investigation BCCNM may make a <strong>summary protection order<\/strong>: imposing or varying limits or conditions on your practice authority, or <strong>suspending it<\/strong>.<\/p>\r\n<div class=\"callout\"><strong>It can be made without notice to you and without an opportunity to be heard.<\/strong> Under the old Health Professions Act you were given notice and a chance to respond first. Under the HPOA, you may not be. For an employed nurse or midwife, a suspended practice authority is not an abstraction &mdash; it means you cannot work, and the income stops.<\/div>\r\n<p>The threshold is that the Investigation Committee has reasonable grounds to believe your practice may present a <strong>significant risk of harm<\/strong> to any person. Summary protection orders are <strong>published<\/strong> on the public register.<\/p>\r\n<p>If one is made against you, seek advice the same day. Your route to challenge it is narrow, and it is not the route it used to be.<\/p>\r\n\r\n<h2>How investigations begin<\/h2>\r\n<p>A complaint from a patient or family is only one route. Under <strong>section 124<\/strong>, the Investigation Committee may initiate an investigation with no regulatory complaint at all. In nursing and midwifery, the common triggers are:<\/p>\r\n<ul>\r\n<li>An <strong>employer report<\/strong> &mdash; often following a medication incident, a critical incident review, or a termination.<\/li>\r\n<li>A <strong>peer report<\/strong>. Licensees have a positive duty to report colleagues where they suspect sexual misconduct, sexual abuse or discrimination.<\/li>\r\n<li>A <strong>criminal record review<\/strong> issue, or a report from another provincial regulator.<\/li>\r\n<li>The College&rsquo;s own information and monitoring.<\/li>\r\n<\/ul>\r\n<p>Because the duty to report was widened under the HPOA, workplace conflict now converts into regulatory exposure more readily than it once did. That is a structural feature of the new regime, not bad luck.<\/p>\r\n\r\n<h2>What investigators can do, and what you must do<\/h2>\r\n<p>BCCNM investigators can compel records, interview you and others, and gather evidence relevant to the allegations. The Investigation Committee must investigate and assess the matter under sections 125 to 136.<\/p>\r\n<p>Your duty to cooperate is now a statutory duty under the HPOA. Breaching it is independently actionable. Take advice from CNPS and your union, and then engage properly and on time &mdash; those are not competing options.<\/p>\r\n\r\n<h2>Two proceedings, one set of facts<\/h2>\r\n<p>Nurses and midwives are usually employees. That means a single incident can generate an <strong>employer investigation<\/strong> and a <strong>College investigation<\/strong> running side by side, on the same facts, with different rules, different representatives and different consequences.<\/p>\r\n<p>A statement given in an employer meeting can end up in front of the College. An admission made to secure your job can be read as an admission of unprofessional practice. This is precisely why the union and CNPS need to be involved from the outset, and why nurses should be far more careful than they typically are about giving early, unadvised accounts at work.<\/p>\r\n\r\n<h2>How an investigation ends<\/h2>\r\n<p>The Investigation Committee may:<\/p>\r\n<ul>\r\n<li><strong>Dismiss<\/strong> the matter, including as unfounded;<\/li>\r\n<li>Give <strong>advice or a warning<\/strong>;<\/li>\r\n<li>Resolve it through <strong>consensual complaint resolution<\/strong> &mdash; a negotiated consent agreement, and the route by which the majority of BCCNM complaints are concluded;<\/li>\r\n<li>Impose <strong>limits or conditions<\/strong> on your practice authority;<\/li>\r\n<li><strong>Request a citation<\/strong> from the Director of Discipline under section 137, sending the matter to the Health Professions Discipline Tribunal;<\/li>\r\n<li><strong>Settle<\/strong> a matter for which a citation has been requested, under section 139, with the Director&rsquo;s approval.<\/li>\r\n<\/ul>\r\n\r\n<h2>If it goes to a hearing<\/h2>\r\n<p>Discipline no longer happens inside your College. The matter moves to the <strong>Health Professions Discipline Tribunal<\/strong>, an independent body within the Health Professions and Occupations Regulatory Oversight Office, led by a Director of Discipline. A panel comprises one licensee, a member of the public, and a specialist in the area of concern. Hearings are public.<\/p>\r\n\r\n<h2>The appeal route you no longer have<\/h2>\r\n<p><strong>The HPOA abolished the statutory right of appeal to the courts.<\/strong> Decisions of the Director of Discipline and of discipline panels are final and conclusive and not open to review by any court. The only recourse is <strong>judicial review<\/strong>, which tests procedural fairness &mdash; not whether the decision was right.<\/p>\r\n<p>Decisions of the Investigation Committee, including summary protection orders, are now reviewed by <strong>reconsideration through the College&rsquo;s registrar<\/strong> rather than by appeal to the court.<\/p>\r\n<div class=\"callout\"><strong>The consequence:<\/strong> the record you build during the investigation is, for practical purposes, the only record there will ever be.
