read<\/b><span>Last updated July 14, 2026<\/span><\/div>\r\n\r\n  <p class=\"lede\">A complaint to the College of Registered Nurses of Alberta is not a hearing, and it is not a finding. It is the start of a process under Part 4 of the <em>Health Professions Act<\/em> &mdash; and the single most important thing to understand is that most complaints are resolved without ever reaching a hearing tribunal. How you respond in the first few weeks does more to shape the outcome than almost anything that follows.<\/p>\r\n\r\n  <div class=\"callout\"><p><strong>Before you write anything, get advice.<\/strong> Contact the Canadian Nurses Protective Society (CNPS) or your union, and speak to a regulatory lawyer before you send a written response to the Complaints Director. Do not contact the complainant, and do not add to or amend the clinical record. Both are readily detected and both turn a defensible complaint into a serious one.<\/p><\/div>\r\n\r\n  <h2>Who actually regulates you in Alberta?<\/h2>\r\n  <p>This matters before anything else, because Alberta splits nursing and midwifery regulation across separate colleges. The <strong>College of Registered Nurses of Alberta (CRNA)<\/strong> regulates <strong>registered nurses and nurse practitioners<\/strong>. <strong>Registered midwives<\/strong> are regulated by the <strong>College of Midwives of Alberta (CMA)<\/strong>, under the same <em>Health Professions Act<\/em> together with the Midwives Profession Regulation.<\/p>\r\n  <p>Licensed practical nurses and health care aides fall under the College of Licensed Practical Nurses and Health Care Aides of Alberta, and registered psychiatric nurses under the College of Registered Psychiatric Nurses of Alberta. The good news is that the complaints machinery described here &mdash; Complaints Director, investigation, resolution agreement, hearing tribunal &mdash; comes from <strong>Part 4 of the Health Professions Act<\/strong> and is common to all of them. Only the college changes.<\/p>\r\n  <h2>What counts as a complaint, and who can make one?<\/h2>\r\n  <p>Under <strong>section 54(1)<\/strong> of the Act, a complaint must be <strong>in writing and signed<\/strong>. Alberta does not accept anonymous complaints, so you will know who has complained. Patients and families are the most common source, but colleagues and members of the public can complain too.<\/p>\r\n  <p>A large share of matters arrive from a different direction entirely. <strong>Employers are legally obliged<\/strong> under the Act to report to the college when they discipline a registrant over conduct they believe to be unprofessional &mdash; and that report is <strong>treated as a complaint<\/strong>. Many nurses are first contacted by the CRNA about an incident they thought their employer had already dealt with internally.<\/p>\r\n  <h2>What happens in the first 30 days?<\/h2>\r\n  <p>The <strong>Complaints Director<\/strong> (or an Associate Complaints Director) reviews the allegations and decides how the matter will proceed. Within <strong>30 days of receiving a complaint<\/strong>, the Complaints Director must notify the complainant of the action being taken.<\/p>\r\n  <p>You will be <strong>given a copy of the complaint<\/strong>, along with the complainant&rsquo;s name, though not their contact details. From that point the Complaints Director can dismiss the complaint, attempt to resolve it without an investigation, direct an investigation, or refer the matter onward. You are entitled to <strong>representation<\/strong> throughout &mdash; by a lawyer, a union representative, or an agent of your choosing.<\/p>\r\n  <h2>How your response is read<\/h2>\r\n  <p>A written response to the Complaints Director is not a formality and it is not a conversation. It becomes part of the record, it can be put before a hearing tribunal, and it will be read closely for one thing above all: whether you understand what happened.<\/p>\r\n  <p>The responses that go badly are defensive, blame the patient or the employer, minimise the concern, or read as though written in anger. The responses that go well are factual, anchored in the <a href=\"https:\/\/healthcareethicscourses.com\/can\/courses\/documentation-for-healthcare-professionals\/\">clinical record<\/a> as it was written at the time, and demonstrate genuine <a href=\"https:\/\/healthcareethicscourses.com\/can\/courses\/insight-for-fitness-to-practise\/\">insight<\/a> &mdash; an honest account of what occurred, what you would do differently, and what you have already changed. That is not a tactic; it is what the Act&rsquo;s whole framework is designed to elicit.<\/p>\r\n  <h2>Resolution without a hearing: the EAR route<\/h2>\r\n  <p>Alberta has a distinctive and genuinely useful mechanism. <strong>Expedited alternate resolution (EAR)<\/strong>, under <strong>section 55(2)<\/strong>, allows a complaint to be resolved <strong>without a hearing &mdash; and sometimes before an investigation even begins<\/strong>. It requires the agreement of both the complainant and the registrant.<\/p>\r\n  <p>Most commonly EAR produces a <strong>complaint resolution agreement (CRA)<\/strong> between you and the college, and the type matters enormously. A <strong>non-disciplinary CRA (NDCRA)<\/strong> is <strong>confidential<\/strong> and does <strong>not<\/strong> amount to a history of discipline. A <strong>disciplinary CRA (DCRA)<\/strong> is <strong>not confidential<\/strong>: a summary is <strong>published on the CRNA website<\/strong> and it <strong>does<\/strong> count as a discipline history. Which one is on the table is one of the most consequential questions in your entire case, and it is a question for your lawyer.<\/p>\r\n  <h2>What can happen to your practice permit meanwhile?<\/h2>\r\n  <p>In most cases you continue to practise normally while a complaint is dealt with. But where a complaint raises a significant risk to the public &mdash; typically allegations touching patient safety, impairment, or sexual boundaries &mdash; <strong>conditions or a suspension can be placed on your practice permit while the process is still running<\/strong>, before any finding has been made.<\/p>\r\n  <p>Complaints of a sexual nature are treated with particular seriousness. Under Alberta&rsquo;s patient-protection legislation, a finding of <strong>sexual abuse<\/strong> of a patient carries <strong>mandatory cancellation<\/strong> of the practice permit. If your matter touches this territory, legal representation is not optional.<\/p>\r\n  <h2>What you should do this week<\/h2>\r\n  <p>Contact <strong>CNPS<\/strong> or your union today and instruct a regulatory lawyer. Diarise every deadline in the letter you received. Preserve the record exactly as it stands &mdash; never amend, backdate, or clarify an entry after the fact. Say nothing to the complainant.<\/p>\r\n  <p>Then begin the work that will actually help you: a candid reflective account, and concrete steps that show the concern will not recur.
