A <strong>notification<\/strong> is simply the formal term for a concern or complaint raised about a registered health practitioner or student. Concerns usually fall into one of three broad areas: <strong>conduct<\/strong> (behaviour), <strong>performance<\/strong> (clinical care), and <strong>health<\/strong> (an impairment that may affect safe practice).<\/p>\r\n      <p>The purpose of the process is to protect the public, not to punish practitioners. The test AHPRA and the Boards apply is risk to the public \u2014 not retribution. AHPRA carries out the operational work of gathering information, while the relevant National Board is the decision-maker.<\/p>\r\n      <aside class=\"note\"><span class=\"note-h\">Different rules in NSW and Queensland<\/span><p>Health regulation works slightly differently in two states. In <strong>New South Wales<\/strong>, concerns are managed under a co-regulatory model involving the Health Care Complaints Commission (HCCC) and the relevant professional Council. In <strong>Queensland<\/strong>, the Office of the Health Ombudsman (OHO) receives complaints and may handle or refer them. The underlying principles \u2014 assess, investigate where needed, and act to keep the public safe \u2014 are very similar.<\/p><\/aside>\r\n      <h2>Who can make a notification?<\/h2>\r\n      <p>There are two kinds of notification, and the difference matters.<\/p>\r\n      <h3>Voluntary notifications<\/h3>\r\n      <p>Anyone can make a voluntary notification \u2014 a patient, a family member, a colleague, an employer or a member of the public. People who notify in good faith are protected by law from civil, criminal and administrative liability, including defamation.<\/p>\r\n      <h3>Mandatory notifications<\/h3>\r\n      <p>Registered practitioners, employers and education providers are required by law to make a mandatory notification in defined, limited circumstances. The threshold is deliberately high, and the requirements were changed on 1 March 2020 to make it easier for practitioners to seek their own health care without fear of being reported.<\/p>\r\n      <p>The four types of <strong>notifiable conduct<\/strong> that can trigger a mandatory notification are where a practitioner has:<\/p>\r\n      <ul>\r\n        <li>practised while intoxicated by alcohol or drugs;<\/li>\r\n        <li>engaged in sexual misconduct in connection with their practice;<\/li>\r\n        <li>placed the public at risk of substantial harm because of an impairment; or<\/li>\r\n        <li>placed the public at risk because of a significant departure from accepted professional standards.<\/li>\r\n      <\/ul>\r\n      <aside class=\"note\"><p>If you are ever unsure whether you must make a mandatory notification about a colleague, your indemnity insurer, professional association or a lawyer can help you weigh it up. AHPRA can give general information but cannot tell you whether to notify in a specific case.<\/p><\/aside>\r\n      <h2>What a notification is \u2014 and isn\u2019t<\/h2>\r\n      <p>A notification is <strong>not<\/strong> a criminal charge, and it is <strong>not<\/strong> a finding that you have done anything wrong. It is the start of a process in which information is gathered and assessed.<\/p>\r\n      <p>The fact that a notification has been made does not automatically restrict your registration. Every notification is managed individually, and most are resolved with no further regulatory action. Matters are handled confidentially and according to the principles of natural justice (procedural fairness) \u2014 you will generally be told the substance of the concern and given an opportunity to respond.<\/p>\r\n      <h2>What happens after a notification is made?<\/h2>\r\n      <p>In outline, the process usually runs as follows:<\/p>\r\n      <ul>\r\n        <li><strong>You are informed.<\/strong> AHPRA usually contacts you \u2014 often by phone and then in writing \u2014 to tell you a concern has been raised. Occasionally it cannot tell you straight away if doing so would prejudice the matter or public safety.<\/li>\r\n        <li><strong>Assessment.<\/strong> AHPRA assesses the concern and the level of risk, generally aiming to complete this within about 60 days.
